CRE8TAR Terms and Conditions

Welcome to CRE8TAR. These Terms and Conditions (“Terms”) govern your access to and use of the CRE8TAR ecosystem, including our AI-powered avatar platform, NFT minting services, blockchain-based interactions, staking features, and any other tools or services we make available (“Services”).

By creating an account, participating in our marketplace, staking tokens, minting avatars, or otherwise interacting with CRE8TAR, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use our Services.

To use CRE8TAR, you must meet the following conditions:

• You must be at least 13 years old to use the platform.
• Users under 18 may only use the platform with consent from a parent or guardian.
• You must have the legal capacity to enter binding contracts in your jurisdiction.
• You agree not to misuse the platform, impersonate other users, or engage in unlawful or harmful activities.

Prohibited conduct includes hacking, spreading malware, interfering with blockchain transactions, exploiting bugs, or attempting to bypass security controls.

All AI models, platform code, interface design, trademarks, and branded content are the exclusive intellectual property of CRE8TAR or our licensors.

You retain ownership of your inputs (such as prompts, text, or uploaded assets). However, by using them within CRE8TAR, you grant us a non-exclusive, worldwide, royalty-free license to use such inputs for avatar creation, content generation, system improvement, and research purposes.

Unauthorized reproduction, redistribution, or exploitation of CRE8TAR content outside permitted use cases may result in legal action.

Avatars, assets, or collectibles generated on CRE8TAR may be minted as NFTs. Once minted, blockchain records are permanent and cannot be reversed.

Fusion, transfer, or staking actions are final once confirmed on the blockchain. CRE8TAR cannot undo or modify blockchain transactions.

You are solely responsible for your crypto wallets, private keys, and security practices. CRE8TAR is not liable for losses caused by lost credentials, phishing, or unauthorized access.

You may use generated avatars for personal use and limited commercial purposes (such as streaming, content creation, and branding) unless otherwise restricted.

You may not:

• Reverse engineer or replicate CRE8TAR"s AI models.
• Use avatars for impersonation, identity theft, fraud, or harassment.
• Create or distribute avatars that contain hateful, illegal, or harmful content.
• Misrepresent avatars as official CRE8TAR assets unless minted or licensed accordingly.

Payments for subscriptions, NFT minting, and related services are processed via third-party providers. CRE8TAR does not directly store payment credentials.

Refunds are available only within 3 calendar days of purchase, and only if the service has not been consumed in irreversible ways (e.g., NFTs already minted, avatars fused, or assets transferred on-chain).

Gas fees, blockchain transaction costs, and third-party service fees are non-refundable.

CRE8TAR provides Services “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, or non-infringement.

We are not responsible for misuse of avatars or NFTs, third-party wallet or marketplace issues, market volatility, or emotional and reputational consequences arising from avatar usage.

In no event shall CRE8TAR"s liability exceed the total fees you paid to us in the 12 months prior to a claim.

CRE8TAR may suspend or terminate your access to the Services if you:

• Violate these Terms.
• Use avatars for illegal, fraudulent, malicious, or harmful purposes.
• Exploit the platform in ways that damage the ecosystem.

Termination may include revoking access, forfeiting staked tokens, and reporting violations to relevant authorities if required.

Certain CRE8TAR NFTs may grant governance rights within the CRE8TAR DAO. Participation is governed by the relevant smart contracts and on-chain rules, which may evolve over time.

CRE8TAR does not guarantee specific outcomes of DAO votes or proposals.

We may update these Terms, features, or policies at any time. Updates take effect once posted on our site or platform interface.

Continued use of the Services after updates constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
